Is there a time limit for making a brain or head injury compensation claim?
In general, the standard time limit to start a personal injury claim is 3 years from the date you were injured or you were first aware that you were injured.
If you are claiming on behalf of someone who no longer has the mental capacity, there is no time limit to making a claim. Should they regain capacity in the future, the 3-year time limit is counted from this date.
If a brain or head injury is sustained by someone under 18, the 3-year time limit only takes effect from their 18th birthday and only if they have the mental capacity to make a compensation claim themselves.
